Minnesota Residential Building Contractor licensing, explained

About the Minnesota Residential Building Contractor license

Minnesota licenses residential contractors through the Minnesota Dept. of Labor and Industry (DLI) under Minnesota Statutes Chapter 326B (§ 326B.802 et seq.). A Residential Building Contractor license is required when you contract directly with a homeowner to build or improve residential real estate of one to four dwelling units and your work involves two or more of the eight statutory "special skills" (excavation; masonry and concrete; carpentry; interior finishing; exterior finishing; drywall and plaster; residential roofing; general installation specialties). A contractor providing only one special skill, or working as a subcontractor not contracting directly with the owner, generally registers rather than licenses. The license is held through a qualifying person (Q) who passes the exam and completes continuing education. The licensed contractor enters into the prime contract, pulls the building permit, and is responsible for the whole project — scheduling and coordinating subcontractors, means and methods, jobsite safety, and delivering work that passes inspection and meets the contract.

Your technical exam is built on the 2020 Minnesota Residential Code (the IRC-based residential code as amended by Minnesota, supplied by DLI). Know these scope facts cold: the license is held by the qualifying person/entity; most work requires a permit and inspections at defined milestones (footing, foundation, framing, rough trades, insulation, final); you must work within the scope you hold; and unlicensed or out-of-scope contracting is a violation that can void contracts, forfeit the right to collect payment, and carry penalties.

How Minnesota licensing works

  • Qualifying person: each licensed contractor designates a qualifying person (Q) who passes the exam and completes the required continuing education.
  • Financial responsibility: Minnesota requires general-liability and (with employees) workers' compensation insurance; the state's consumer protection comes mainly through the Contractor Recovery Fund (funded by licensee surcharges) rather than a per-contractor surety bond.
  • Application: submit the application, fees, proof of insurance, and entity documents to DLI after the qualifying person passes the exam.
  • Exam: the qualifying person sits the DLI qualifying builder exam described in the sitting card at the top of this guide. It is not the remodeler exam and not the roofer exam.
  • Renewal: the residential building contractor license renews on a two-year cycle (business licenses expire March 31), and the qualifying person's registration likewise renews every two years — the Q must complete 14 hours of DLI-approved continuing education per two-year cycle, including at least 1 hour on the energy code and at least 1 hour on business-management strategies — plus keep insurance current.
